Acceptance of Terms

These Terms govern your use of Contextter. When you create an account or use the service, you enter into the relevant service agreement with the provider named in the Imprint. Mandatory legal rights, in particular consumer rights, remain unaffected.

Description of Service

Contextter combines an owned keyword database with technical site audits and deliberately triggered SEO data requests. The exact scope depends on your plan, workspace permissions and the availability shown in the product. It includes, in particular:

• Importing or adding keywords, organizing them with lists and tags, filtering, clustering and exporting them
• Requesting keyword, SERP, domain, competitor and backlink data, with paid actions identified before they start
• Crawling websites and reviewing technical findings, affected URLs, internal links and changes between audit runs
• Using workspaces, roles, saved views, priorities and recurring checks where the applicable plan enables them
• Using clearly identified AI-assisted analysis or research features and reviewing their output before making a business decision

User Accounts

The signed-in application requires an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You must be an adult to create your own account. If you use Contextter for an organization, you must have authority to act for that organization.

Your Data and Results

Your data: You retain the rights to data and materials you bring into Contextter. Contextter does not claim ownership of them.

License to Us: You allow us to store, copy, technically transform and send that data to the providers needed for a workflow, but only as required to operate, support and secure the service or run the feature you requested. Legal retention duties and limited backup cycles may continue after deletion.

Automated results: Contextter does not claim its own rights in automatically generated results. Whether and to what extent a result is legally protected depends on applicable law and your contribution. Check facts, third-party rights and suitability before publishing or relying on it.

Acceptable Use

You must not use Contextter to:

• Process unlawful, harmful, threatening or abusive data or prepare unlawful acts
• Infringe copyright, trade mark, privacy or other third-party rights
• Support spam, deception, manipulation or misleading publication at scale
• Attempt to bypass usage limits or security measures
• Resell or redistribute our services without authorization
• Use undocumented automated access that harms the service's stability, security or fair use

If these rules are breached, we may proportionately restrict or suspend the affected access. Where reasonable, we consider severity, recurrence risk and whether the issue can be remedied.

Usage and Billing

Certain external data and AI actions are billed against a EUR balance. Organizing, filtering and exporting does not consume balance unless the product says otherwise before an action starts. For a paid action, Contextter shows an estimate before confirmation and settles the amount actually run under the pricing shown in the product.

• Plan balance: Every paid plan adds a EUR balance to your organization at the start of each billing period.
• Top-ups: You can buy additional balance at any time as a one-off payment, independently of your plan.
• Trial and campaign balance: We may grant trial, welcome, or campaign balance at our discretion. It is not redeemable for cash and can be revoked.

Reserved amounts are settled against actual usage or released after the job. Each charge appears in the billing history. Balance is not a bank deposit, has no cash value and is not paid out unless mandatory law requires otherwise.

Merchant of record: Polar is the seller and merchant of record for paid subscriptions and top-ups. Polar collects billing and tax details, processes payment, and issues invoices and receipts. Contextter provides the digital service and credits the purchased EUR balance.

Payments, Cancellations and Refunds

Subscriptions and top-ups do not carry a general voluntary money-back guarantee. Whether a refund is due depends on mandatory law, the specific failure to perform and the terms shown at checkout.

Cancellation stops future renewals and normally takes effect at the end of the current paid billing period. It does not reverse payments already made. Existing prepaid balance remains available.

Mandatory rights remain unaffected, including valid consumer withdrawal and remedies for non-provision or defective digital products. Polar may also process refunds required by law, card-network rules or chargeback prevention. Consumers can submit an electronic withdrawal declaration using our withdrawal function. Service Availability

We operate Contextter with reasonable care, but cannot promise uninterrupted or error-free access. Maintenance, security measures, provider failures and technically necessary changes may temporarily limit a feature. We give advance notice of planned material interruptions where possible.

Limitation of Liability

Our liability follows the rules below. Mandatory statutory liability always remains unaffected:

• We are fully liable for intent and gross negligence, injury to life, body or health, and any case of mandatory statutory liability
• For a slightly negligent breach of an essential contractual duty, liability is limited to the typical loss that was foreseeable when the contract was made
• Liability for other slight negligence is excluded; statutory warranty and consumer rights are not reduced

Responsibility for Your Use

You are responsible for data you submit, requests you start and results you publish. If your culpable unlawful use causes a valid third-party claim, you must compensate us for the resulting loss under applicable law. For consumers, this applies only to the extent permitted by law.

Modifications to Terms

We may update these Terms for the future when the service, law, or legitimate security and operational requirements change. We provide timely notice of material changes. Where your consent is required, we will request it; silence does not replace consent required by law.

Governing Law

German law applies. If you are a consumer, mandatory protections of the country in which you usually live remain unaffected.
